www.elperiodicodearagon.com The Court of Administrative Disputes Zaragoza No. 4 has agreed to halt disciplinary suspension imposed on the municipal secretary of Muel by the local mayor Luis Gil. According to the resolution, the official, Mercedes Crespo, should remain in office, "if it is still possible, until the core issue has been resolved by the competent authority.
The case goes back to last March, when the Councillor informed the officer that should begin serving a sentence of four months' suspension without pay, imposed by him, by declining to act as an intervener, in 2008, the plenary session in which the council had to decide if they gave a new use for city-owned housing occupied by the secretary and his family.
Judicial sources said that the court ruling, citing case law of the Constitutional Court says that disciplinary action can not be imposed until it has substantiated the procedure to determine whether there was an irregularity in the conduct of the secretary.
"Mercedes Crespo acted in accordance with the law when it abstained from voting on an issue affecting directly to their interests, "said the sources.
For its part, the mayor of Muel is of the opinion that the secretary can not prepare the minutes in committee or in full, at which time earlier requested that a new secretary replacing the service.
